Welcome to Click-en-collect.nl! The website and mobile applications of Click-en-collect.nl (collectively referred to as the “Application”) are an initiative of Mymeal.mobi Services B.V. (hereinafter: “Click-en-collect.nl”). We are located at Steffensberg 45, 9431 CX Westerbork, Netherlands. Our Chamber of Commerce number is 70353875. Through the Application, you (hereinafter referred to as “User” or “you”) can order products (hereinafter referred to as the “Offer”) from restaurants and food or cooking product sellers (hereinafter referred to as “Partners”). In addition, you have the option to reserve at Partners. On the website Click-en-collect.nl, logged-in Users can use a number of interactive features, such as sharing content on an account you create. Below you will find our general terms and conditions. These terms and conditions apply to the use of our Application and ordering of the Offer through the Application from one of our Partners. We advise you to read the terms and conditions carefully before using our Application. We want our Application to continue to develop with a focus on ease of use for Users. Click-en-collect.nl will therefore always take into account feedback from Users. You can find answers to most frequently asked questions at our FAQ. For questions, comments, or complaints, or if you encounter problems with your account, you can always contact us via info Click-en-collect.nl or via our contact page. You will receive a response within five (5) working days.

Offer and Agreement On the Click-en-collect.nl Application, the Offer of Partners is displayed which you can order. If you place an order, you will receive a confirmation by email from us, on behalf of our Partner, that the order has been received and whether it is accepted. If your order is accepted, an agreement is established between you and our Partner. Click-en-collect.nl only acts as an intermediary for our Partner. The agreement can only be executed by our Partner if you provide correct and complete contact details. We use your email address to inform you about the status of your order and need your address and phone number to deliver the order correctly. Upon delivery of your order, the delivery person may ask for identification if your order contains alcoholic products or other products with an age limit. If you do not meet the minimum age or cannot identify yourself, the relevant products will not be delivered to you. You will not receive a refund of the paid amount. If no one answers at the specified address and there is no response to a telephone message, the order may be canceled. You will not receive a refund of the paid amount.

Allergies Orders may contain foodstuffs that you may be allergic to. If you are allergic to certain foods, please contact our Partner for current allergen information before placing an order. Click-en-collect.nl cannot guarantee that every order containing foodstuffs is free of allergens.

Cancellation or Return If you wish to cancel an order, you must contact the Partner where your order was placed. Cancellation is only possible if the Partner explicitly states this. Click-en-collect.nl and Partners reserve the right to cancel an order at any time. In that case, you will be informed as soon as possible. In case of timely cancellation of the order, a prior payment made by Click-en-collect.nl or Partner will be refunded. If you are not satisfied with the products you have ordered? Then contact the Partner where you placed your order within 14 calendar days. The following products cannot be returned: Products that perish quickly or have a limited shelf life; Sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery; Products that are irrevocably mixed with other products after delivery.

Price and Payment If an agreement has been established between you and Partner, you are obliged to pay the amount due. All prices displayed in the Click-en-collect.nl Application include VAT. Before placing an order, you will be informed of any delivery costs. Payment is made via an online payment method through the Application and is made to Click-en-collect.nl. Click-en-collect.nl is authorized by Partners to receive payments. Prices may vary and can be changed at any time. A price change does not affect an order you have placed that has been confirmed.

Reservations Through our Application, you also have the option to reserve a table at Click-en-collect.nl affiliated Partners. Through the Application, you choose a day, time, and number of people. A reservation is final when our Partner has accepted the reservation and you have received a confirmation email. A reservation is only valid on the day and time as shown in the confirmation email. Cancellation is free of charge and can only be done by contacting the Partner directly.

Security and Availability You can count on it, we offer a user-friendly Application that is safe for everyone. We take all reasonable measures necessary to ensure the proper functioning, security, and accessibility of the Application. These are measures of both a technical, non-technical, and organizational nature. However, we cannot give you absolute guarantees. The commitment we enter into is only an effort commitment. We strive to achieve the best possible response time and access for you. We reserve the right to restrict access to our Platform at any time and/or to interrupt it in whole or in part, even without prior warning. We do this in principle only if the circumstances require it, but this is not an absolute condition. Click-en-collect.nl is never liable for compensation in connection with limited access or decommissioning. Any use of the Application is always at your own risk. This means that we do not bear any liability for damage resulting from malfunctions, interruptions, harmful elements, or defects in our Platform, regardless of the existence of force majeure or a foreign cause. Click-en-collect.nl makes its Platform available "AS IS" and "AS AVAILABLE", meaning without any explicit or implicit guarantee regarding the proper functioning, accessibility, and security.

Application Terms of Use Registration You also have the option to create an account on the Application. You can register with your own email address and a password of your choice. Information about your account (password changes, confirmation messages, etc.) is only sent electronically to the email address you provided. Click-en-collect.nl is completely free to determine the registration conditions at its discretion and to adjust them at any time. When registering and further using, you must enter correct, truthful, current, and complete data. Each User account is strictly individual, personal, and confidential. You are exclusively responsible for all actions performed under the User account. You are also responsible for the confidentiality of your login details and User account.

Behavioral Rules With an account, you have access to interactive features on parts of the Application, such as sharing recipes or following other User accounts. As a User, you must refrain from actions that have or may have a harmful impact on the proper functioning and security of the Application or other Users. The following actions are strictly prohibited: Using software programs aimed at the collection and acquisition of data, including spiders, crawlers, robots, and similar software. This list is not exhaustive. Unauthorized access to the content of the Application. Using a foreign identity and/or foreign data at registration. Investigating or testing the security of Click-en-collect.nl or circumventing the technologies used by Click-en-collect.nl, its licensors, or other third parties to protect the content or service; Spreading insults, threatening language, texts, or photos that violate good morals, or pornographic, coarse, and racist language. Infringements of intellectual property rights, including copying, redistributing, imitating, 'ripping', transferring, displaying to the public, broadcasting, or making available to the public the service or content of the Click-en-collect.nl Platform or otherwise using the Click-en-collect.nl Platform or the content that is not expressly permitted under these terms of use or applicable legislation. Spreading computer viruses that may damage the Click-en-collect.nl Platform. The above list is not exhaustive. You accept that Click-en-collect.nl, if there is a reasonable cause for it, can monitor your data and behavior in connection with the aforementioned abuse. We strive to investigate complaints from Users and take appropriate measures. Complaints regarding the aforementioned abuse can be reported via info Click-en-collect.nl or via the contact page.

Sanctions Click-en-collect nl has the right to take all reasonable and appropriate measures if you as a User act in violation of these conditions and/or applicable legal rules, the rights of third parties, or generally accepted internet behavioral rules. Click-en-collect.nl retains a wide margin of choice regarding taking a sanctioning and remedial measure and the scope of that measure. However, measures will always be in proportion to the infringement. Click-en-collect.nl has, among other things, the option to permanently or temporarily delete your account or content uploaded by you on our Application. Click-en-collect.nl will inform you of this, stating the reason. When circumstances require it, these measures can be taken without any prior warning or notification. You cannot claim a refund or compensation as a User for the measures taken. If you believe that the measure taken is inappropriate or unfounded, you must report this to Click-en-collect.nl within fourteen (14) calendar days after the measure has been imposed. Click-en-collect.nl will consider the arguments without being obliged to reverse the initial measures.

Privacy When you use our Application, you share certain personal data with us. We attach great importance to your privacy and personal data. Therefore, we would like to inform you about our policy regarding personal data. For this purpose, we refer you to our privacy policy, which provides more information about the guarantees regarding the protection of your personal data.

Liability and Force Majeure: You use our platform at your own risk, and we are not liable for any damage you may suffer as a result of using our Application. We also do not accept liability for incomplete or incorrect content on the Application. Click-and-collect.nl is only liable for any gross negligence or repeated minor contractual and/or extra-contractual failures attributable to it in the execution of its obligations under these Terms of Use. This liability is limited to the direct damage resulting from the failures and can never exceed the price of the order you have paid. If Click-and-collect.nl is wholly or partly prevented from fulfilling its obligations to you due to circumstances beyond its control, this will be considered force majeure. In such a case, Click-and-collect.nl is not obliged to fulfill its obligations towards you. Click-and-collect.nl is entitled to suspend its obligations for the duration of the force majeure.

Intellectual Property: All intellectual property rights in relation to the Application and the content published on it (excluding contributions from Users) remain with Click-and-collect.nl or with third parties from whom we have permission to use the content. You undertake not to infringe the intellectual property rights of Click-and-collect.nl or any other party. If you, as a User, commit an infringement of the intellectual property rights of third parties, these cannot be attributed to Click-and-collect.nl. Any factual consequences or legal consequences are therefore entirely for your account as a User.

Third-Party Applications: The content of our Platform may contain third-party websites or services or a link, hyperlink, or framed link to foreign websites or other forms of electronic portals ("third-party applications"). Click-and-collect.nl cannot be held liable for any damage resulting from the use of third-party applications. We advise the User to carefully review the terms of use and privacy policy of these other applications.

Changes to These Terms and Applicable Law: We have the ability to adjust our terms from time to time. Dutch law applies to our terms and any disputes arising from them.
